Coles has been caught red-handed. But don’t discount this pricing loophole
Australia's Federal Court ruled Thursday that supermarket chain Coles engaged in misleading conduct by hiking prices before discounting them under its "Down Down" promotion, with 13 of 14 examples found deceptive. Justice Michael O'Bryan determined products must sell at higher prices for 12 weeks before discounts qualify as genuine; most were marked up for only four weeks.
